Terms & Conditions

Creativity Design Studio LLC
Effective Date: October 24, 2026
Website: https://CreativityDS.com
Business Address: 2671 Breaker Ln, Kissimmee, FL 34746

These Terms & Conditions govern use of the Creativity Design Studio LLC website and services, including graphic design, branding, website design, printing, signage, installation, site visits, and related services.

By approving an estimate, signing an agreement, authorizing work, or paying an invoice, you agree to the terms applicable to your project. Any project-specific terms stated in an approved estimate or written agreement take precedence over these general terms where they directly conflict. Applicable legal rights cannot be waived by these terms.

1. Estimates and Project Scope

  • Standard estimates are valid for 10 calendar days from the estimate date.
  • If an estimate is issued following a paid site visit, it is valid for 30 calendar days from the estimate date. This 30-day period replaces the standard 10-day period.
  • Estimates cover only the services, quantities, deliverables, and specifications listed in them.
  • Work outside the approved scope, including new concepts, additional deliverables, changed specifications, or additional services, may require a revised estimate and additional payment.
  • Prices, timelines, discounts, credits, and payment stages will be stated in the estimate where applicable.
  • Work does not begin until the required payment has been received and the funds are available for use, unless otherwise agreed in writing.
  • An estimate is not a guarantee of availability, production timing, or third-party pricing after its validity period expires.

2. Design Fees and Project Payments

Projects over $600

Unless the approved estimate expressly states otherwise:

  • The Design Fee is listed separately and is payable in full before design work begins.
  • The Design Fee is separate from the project deposit and is not credited toward the deposit.
  • A separate deposit equal to 50% of the project price is required before production, fabrication, installation, or other project execution begins.
  • The 50% deposit is calculated on the project price after any expressly approved discount and excluding the separately listed Design Fee and Site Visit Fee.
  • The remaining project balance is due at the stage stated in the estimate or, if no stage is specified, upon completion and before final files, finished products, website launch, or other final deliverables are released.

Design Fee retention. Once design work begins, the Design Fee may be retained to compensate Creativity Design Studio LLC for design labor and related work performed. Any refund will be determined under the approved agreement and applicable law, including any cancellation or refund right that cannot legally be waived. Design work is considered to have begun on the date Creativity Design Studio LLC first produces or delivers a concept, draft, or design file.

Projects of $600 or less

For projects with a quoted total of $600 or less, full prepayment is required before work begins. That payment covers the quoted project, including design, and no separate project deposit is required unless the estimate expressly states otherwise.

The approved estimate must clearly show the Design Fee, project price, applicable discount or credit, amount due before each work stage, and remaining balance. If the estimate uses a different payment structure, that structure must be stated clearly before approval.

3. Payment Processing and Availability of Funds

Accepted payment methods may include Zelle, ACH/bank transfer, cash, checks, and card payments when offered. The available methods and payment instructions will be shown on the estimate or invoice.

  • Payments must be made in the amounts and at the stages specified in the approved estimate or invoice.
  • Work begins only after the required funds have reached Creativity Design Studio LLC's bank account and are available for use.
  • A payment provider's notification that a card or ACH payment is "successful" does not by itself mean the funds have reached our bank or are available.
  • Card and ACH payments are subject to processing and settlement by the payment provider and the client's bank. Timing may vary due to verification, first-payment holds, weekends, bank holidays, account reviews, or other delays outside our control.
  • Checks are accepted when approved by Creativity Design Studio LLC. A check must be received and its funds must be available for use before related work begins. Work will not begin while funds remain on hold or are otherwise unavailable.
  • The client is responsible for ensuring payment is sent using the correct details and for any fees charged by the client's bank or payment provider.
  • Final payment must be received before final files, finished products, website launch, transfer of ownership, or other final deliverables are released, unless otherwise agreed in writing.

Zelle TAG: CreativityDs

Do not send payment to different details unless Creativity Design Studio LLC confirms the change through a verified communication channel.

4. Discounts and Payment Methods

Discounts may be offered for eligible payments by Zelle, ACH/bank transfer, or cash when expressly stated in the estimate or invoice.

  • Any discount must be disclosed before the client approves the estimate.
  • The estimate or invoice will show the applicable price, discount, and final amount due.
  • A discount applies only to the services or items identified in the estimate or invoice.
  • Unless expressly stated otherwise, the discount is applied before calculating the 50% project deposit.
  • No payment-method discount is available unless it is shown in writing.
  • Creativity Design Studio LLC does not add an undisclosed payment-method fee. Any other permitted fee must be disclosed before the client authorizes the transaction.

5. Site Visit and Measurement Fees

When a customer requests an on-site visit for measurements, project assessment, or installation planning, a Site Visit Fee must be paid before the visit is scheduled. The amount will be quoted in writing before payment.

The fee covers travel, measurements, photographs, site assessment, and preparation of the project estimate, as applicable to the requested visit.

Site Visit Fee credit

If the customer approves the estimate and proceeds with the project, Creativity Design Studio LLC may credit up to 70% of the Site Visit Fee toward the project. The actual credit percentage and dollar amount will be stated in the estimate before approval, and the credit will be applied to the invoice identified in that estimate. The credit has no cash value and is not transferable to another project unless agreed in writing.

Separate from project price

The Site Visit Fee is separate from the project price. Paying for a site visit does not obligate the customer to hire Creativity Design Studio LLC, and does not obligate Creativity Design Studio LLC to accept the project.

Once the visit and the associated estimating work have been performed, the Site Visit Fee compensates Creativity Design Studio LLC for those services. If the customer chooses not to proceed, no further project payment is due solely because the visit and estimate were completed.

Rescheduling and cancellations

  • The customer may reschedule once without an additional fee by giving at least 24 hours' notice.
  • If the customer cancels with less than 24 hours' notice, or does not attend the agreed appointment, the Site Visit Fee may be retained to compensate for reserved time and preparation, to the extent permitted by law and subject to any refund right that cannot legally be waived.
  • If Creativity Design Studio LLC cancels the visit for its own reasons and does not reschedule by agreement with the customer, the Site Visit Fee will be refunded in full.

These terms do not limit any cancellation or refund right that cannot legally be waived.

6. Design Services and Revisions

Unless the approved estimate states otherwise, the project includes up to three revision rounds requested within seven calendar days after delivery of the applicable draft.

  • A revision round means one consolidated set of changes to an existing concept or draft.
  • Revisions adjust the approved direction. A new concept, new direction, additional deliverable, or substantial scope change may be treated as additional work.
  • Additional revisions are billed at $50 per hour.
  • Any minimum billing increment or additional charge must be disclosed and approved before the additional work begins.
  • Revision requests must be clear and submitted in writing.
  • Delays in receiving feedback, content, approvals, or required materials may affect the delivery schedule.

After the included revision period expires, requested changes may be billed separately. Approval of a design or proof confirms the client's acceptance of the content and specifications shown, subject to any rights that cannot legally be waived.

7. Client Responsibilities and Delays

The client agrees to provide accurate information, required text, images, logos, access, approvals, measurements when applicable, and other materials needed for the project.

The client is responsible for reviewing names, spelling, contact information, prices, dates, dimensions, colors, links, and other details before approving final proofs or deliverables.

If the client does not respond or provide required materials, the project may be paused. After 15 calendar days of inactivity, Creativity Design Studio LLC may notify the client that the project is on hold. If there is no response within 30 calendar days after that notice, the studio may close or archive the project.

Any restart, rescheduling, storage, or additional work charges must be disclosed and agreed to before being charged. Pausing or archiving a project does not eliminate payment obligations for work already performed or costs already incurred, subject to applicable law and any cancellation rights.

8. Cancellations, Refunds, and Deposits

A client who wishes to cancel must notify Creativity Design Studio LLC in writing as soon as possible.

Deposits and advance payments are applied toward the project price. They are not automatically forfeited solely because a client cancels.

When a project is cancelled, the amount retained will be based on the circumstances, including:

  • Work completed up to the effective cancellation date.
  • Reasonable costs already incurred for the project.
  • Non-cancellable third-party commitments made for the project.
  • Materials ordered, production started, or capacity specifically reserved for the project, where a reasonable cost can be supported.
  • Any applicable refund or cancellation rights under law.

Creativity Design Studio LLC may document the work performed and costs incurred to determine the amount properly payable. Any amount paid in excess of the amount properly due will be refunded, subject to applicable law and the terms of the approved agreement.

If Creativity Design Studio LLC cancels a project without client breach and cannot reasonably complete the agreed work, the client will receive a refund for amounts paid for work not performed, less any amounts lawfully owed for completed work or costs that may legally be retained.

If a project is cancelled because of fraud, unlawful requests, abusive conduct, or a material client breach, the studio may pause or end the work. Any amount retained or refunded will remain subject to the approved agreement and applicable law.

Nothing in these terms limits any statutory cancellation, rescission, or refund right that cannot legally be waived.

9. Consumer Cancellation Rights

Some consumer transactions may be subject to mandatory cancellation notices, forms, permits, or refund rules under federal or Florida law, including laws that may apply to certain sales made through personal solicitation away from a seller's fixed business location.

Where a mandatory cancellation right applies, it takes precedence over any inconsistent payment, deposit, site visit, cancellation, or refund provision in these terms. Creativity Design Studio LLC will provide any legally required notices or documents for covered transactions.

Clients should use the cancellation instructions stated in the applicable agreement or legally required notice. If no special form is required, a written cancellation notice may be sent to the business address listed in these terms. This paragraph is not a substitute for any specific notice or form required by law.

10. Printing, Signs, and Physical Products

Colors, finishes, materials, and appearance may vary between digital previews, displays, production equipment, inks, substrates, and finished products. Exact screen-to-print color matching cannot be guaranteed unless expressly agreed in writing.

  • The client must review and approve proofs, spelling, measurements, artwork, quantities, materials, and specifications before production.
  • Production begins after the required payment and approvals are received.
  • The client should inspect delivered products promptly and report visible damage, defects, shortages, or discrepancies in writing within five business days of receipt, with photographs or other supporting details when reasonably available.
  • Reporting a problem within five business days helps the studio investigate promptly. It does not waive any rights that cannot legally be waived.
  • Remedies for confirmed production defects or errors attributable to the studio may include correction, replacement, reprinting, or an appropriate refund, depending on the issue and applicable law.
  • Differences caused by client-supplied files, approved proofs, requested specifications, normal material variation, or conditions outside the studio's control may not constitute a production defect.

Magnetic signs require a suitable ferrous metal surface and may not adhere properly to aluminum, plastic, fiberglass, or other non-ferrous materials. The client is responsible for confirming surface suitability and following any product-specific care or installation instructions.

11. Installation and Site Conditions

Installation is included only when listed in the approved estimate.

The client must provide safe, timely, and lawful access to the installation location and disclose known site restrictions, hazards, surface conditions, access limitations, property rules, and required permissions.

Unless expressly included in the estimate, the client is responsible for obtaining property-owner approval, permits, landlord or association approvals, utility locates, and other authorizations required for the project.

Installation results may depend on weather, surface condition, site access, existing structures, and other factors outside the studio's control. If conditions make installation unsafe or materially different from the approved scope, work may be postponed and any additional cost must be discussed and approved before it is incurred.

12. Website Design and Development

Website projects include only the pages, functions, content, integrations, and services identified in the approved estimate.

  • The client is responsible for supplying accurate content and ensuring that they have the rights to use all supplied text, photographs, logos, videos, and other materials.
  • Additional pages, features, integrations, content entry, revisions beyond the included scope, or other changes may require additional charges approved in writing.
  • Unless expressly included, website projects do not include ongoing maintenance, hosting, domain registration, premium plugin or theme renewals, third-party subscription costs, or ongoing content updates.
  • Delivery and launch depend on timely client feedback, access credentials, content, required approvals, and payment.
  • The studio does not guarantee uninterrupted operation, search engine rankings, traffic, sales, lead volume, or compatibility with every browser, device, service, or future software update.

The client is responsible for maintaining appropriate backups, licenses, access credentials, and security after handover unless a written service agreement assigns those responsibilities to the studio.

13. Website Migration and Third-Party Components

Migration to a different hosting provider is not included unless the approved estimate expressly includes it.

When website files or database exports are delivered for client-managed migration:

  • The client is responsible for completing the migration and confirming that the new environment meets the website's requirements.
  • The client is responsible for ongoing hosting, security, backups, updates, licenses, and support after handover, unless otherwise agreed in writing.
  • Third-party themes, plugins, fonts, stock assets, APIs, and other components remain subject to their respective license terms and may require separate payment or renewal.
  • The studio does not guarantee that third-party components will remain available, secure, compatible, or functional after handover or after changes made by third parties.
  • If temporary credentials are provided, the client must change them promptly and maintain appropriate access security.

The studio is not responsible for problems caused by a third-party host, migration provider, client changes, expired licenses, unsupported software, or an environment outside the studio's control. This does not exclude responsibility that cannot legally be excluded.

14. Hosting and Maintenance

Hosting, maintenance, and support are provided only where included in an active written agreement or invoice.

Unless the service agreement states otherwise:

  • Either party may cancel a recurring hosting or maintenance service with 30 days' written notice.
  • Any renewal period, billing frequency, included support, storage limits, backup policy, and service scope will be stated in the applicable service agreement or invoice.
  • Prepaid service fees will be handled according to the service agreement and applicable law. No term in this section removes a refund right that cannot legally be waived.
  • Overdue payments may result in suspension after reasonable notice, subject to any applicable legal requirements and the service agreement.
  • After a hosting service ends, the client should arrange to obtain any needed website files, exports, and backups before termination.
  • Unless otherwise agreed in writing or required by law, hosting-account data may be deleted 30 calendar days after service termination. The client is responsible for securing a copy of needed data before deletion.

The 30-day hosting data deletion period is separate from the 90-day archived project-file policy in Section 15.

15. Delivery, Storage, and Archived Files

Digital deliverables may be provided by email, a file-sharing service, download link, or another agreed method. Physical goods may be delivered, shipped, or made available for pickup as stated in the estimate.

Unless otherwise agreed in writing:

  • The client should download and securely store final files promptly after delivery.
  • Archived project files may be deleted 90 calendar days after the project is archived or completed.
  • The studio does not guarantee indefinite storage of source files, drafts, exports, or project records.
  • The client is responsible for maintaining their own copies of final deliverables.

Any separate hosting-account data deletion timeline is governed by Section 14.

16. Domains and Third-Party Services

Domain registration and renewal are subject to the registrar's terms, pricing, renewal policies, and availability.

The client is responsible for keeping domain registration details current, ensuring renewal payment, and providing any required authorization. Domain renewal or recovery fees will depend on the registrar and applicable service charges and will be disclosed when known.

Creativity Design Studio LLC is not responsible for interruptions, price changes, suspension, loss, or policy changes imposed by registrars, hosting providers, payment providers, social platforms, search engines, software vendors, or other third parties, except to the extent caused by the studio's own obligations or conduct.

17. Search Engine Optimization and Marketing

Search engine optimization, advertising, and marketing outcomes depend on many factors outside the studio's control, including competition, platform policies, algorithms, budgets, website performance, market demand, and client participation.

Unless expressly guaranteed in a separate signed agreement, Creativity Design Studio LLC does not guarantee specific rankings, traffic, impressions, leads, conversions, revenue, or business results.

Advertising spend, subscriptions, third-party tools, and other external costs are separate unless included in the approved estimate.

18. Intellectual Property and Usage Rights

The client retains ownership of materials they provide, subject to any rights held by third parties.

Upon full payment of all amounts due for the applicable project, the client receives the rights expressly included in the approved estimate or written agreement for the final deliverables created for that client.

Unless expressly transferred in writing, the studio retains ownership of preliminary concepts, unused designs, working files, internal tools, reusable methods, templates, and materials not included in the final deliverables. Third-party fonts, stock assets, plugins, themes, and other licensed components remain subject to their own license terms.

The client may not use unpaid final deliverables or unused concepts without the studio's written permission, except where applicable law provides otherwise.

19. Portfolio and Publicity

Unless the client and studio agree otherwise in writing, Creativity Design Studio LLC may display completed work in its portfolio, website, social media, and promotional materials to demonstrate its services.

The studio will not knowingly publish confidential information supplied by the client as confidential. The client should notify the studio in writing before work begins if the project requires confidentiality, a launch embargo, or restrictions on portfolio use.

Any non-disclosure agreement or written confidentiality arrangement agreed by both parties will control to the extent of any conflict with this section.

20. Client-Supplied Materials and Permissions

The client represents that they have the rights, permissions, and authority needed for materials and instructions they supply, including logos, photographs, text, trademarks, personal images, and other protected content.

The client is responsible for obtaining any necessary permissions and for ensuring that supplied content and requested uses are lawful.

To the extent permitted by law, the client is responsible for third-party claims arising from materials or instructions the client supplied or directed the studio to use, except to the extent a claim results from the studio's own wrongful conduct.

21. Payments, Disputes, and Collections

If the client believes a payment, invoice, or deliverable is incorrect, the client should contact billing@CreativityDS.com promptly with the invoice number and a description of the concern.

Both parties agree to make a reasonable effort to resolve billing or project disputes directly before escalating them, where practical.

Nothing in these terms prevents a client from disputing an unauthorized or incorrect payment with their payment provider or exercising rights available under applicable law. Clients should provide accurate information when raising a dispute and avoid knowingly false claims.

The client remains responsible for undisputed amounts properly due under the approved agreement. Any lawful collection costs, interest, or other recovery will be limited to amounts permitted by the agreement and applicable law. No undisclosed chargeback penalty or automatic cancellation penalty is imposed by these terms.

22. Website Use and Availability

Website content is provided for general informational purposes. While reasonable efforts are made to keep information accurate and current, the studio does not guarantee that all website content will always be complete, error-free, or available without interruption.

You agree not to misuse the website, attempt unauthorized access, interfere with its operation, or use it for unlawful purposes.

Links to third-party websites are provided for convenience. Creativity Design Studio LLC does not control those websites and is not responsible for their content, security, policies, or services.

23. Privacy and Communications

Personal information submitted through the website or in connection with a project will be handled in accordance with the studio's applicable privacy disclosures and policies.

The studio may contact clients about estimates, payments, project requirements, scheduling, delivery, support, and related business matters using the contact details provided. Marketing communications, where applicable, are subject to relevant consent and opt-out requirements.

Clients should not send passwords or sensitive payment credentials by ordinary email. Secure access methods should be used where available.

24. Limitation of Liability

To the extent permitted by law, Creativity Design Studio LLC will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from a project, such as lost profits, lost business opportunities, or loss of data, except where such limitation is prohibited by law.

To the extent permitted by law, the studio's total liability for a claim arising from a specific project will not exceed the amount the client paid to the studio for the specific services or products giving rise to that claim.

These limitations do not exclude liability that cannot legally be excluded or limited, including any rights or remedies that applicable consumer-protection law preserves.

25. Events Outside Our Control

The studio is not responsible for delay caused by events reasonably outside its control, including severe weather, natural disasters, fire, widespread outages, transportation disruptions, supply shortages, third-party service interruptions, or government restrictions.

The studio will make reasonable efforts to communicate material delays and discuss practical next steps. Any payment adjustment, cancellation, or refund will be handled under the approved agreement and applicable law.

26. Electronic Approvals and Records

Where permitted by law, written approvals and communications by email, electronic estimate or invoice acceptance, or other agreed electronic methods may be used to document project scope, pricing, approvals, and changes.

The client is responsible for reviewing documents before approving them and for keeping copies of estimates, invoices, approvals, and payment confirmations.

Electronic communications do not waive any signature, notice, disclosure, or other formality required by applicable law.

27. Governing Law and Disputes

These terms are governed by Florida law, except where another law must apply.

The parties will attempt to resolve disputes through good-faith communication where practical. Any mediation, arbitration, venue, or court procedure must be separately agreed where required and remain subject to applicable law and any non-waivable consumer rights.

Nothing in this section prevents either party from seeking relief in a court that has lawful jurisdiction or from exercising rights that cannot legally be waived.

28. Changes to These Terms

Creativity Design Studio LLC may update these website terms from time to time. The current version will show its effective date.

Updates apply prospectively to website use and new projects after the effective date. An update will not retroactively change an already approved project agreement unless the parties agree in writing or applicable law permits it.

If a material change affects an active recurring service, the studio will provide notice where required by law or the applicable service agreement.

29. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.

These terms, together with the approved estimate, invoice, and any other written agreement for the project, form the agreement between the parties regarding the applicable services. If a project-specific written term conflicts with these general terms, the project-specific term controls for that issue unless it is prohibited by law.

A failure to enforce a provision is not a waiver of the right to enforce it later.
